Mushroom Tour / Education Liability Waiver and Release Agreement 

MUSHROOM TOUR LIABILITY WAIVER AND RELEASE AGREEMENT

This Liability Waiver and Release Agreement (“Agreement”) is entered into between Shasta
Forage, operated by Jayme Castro (“Guide”), and the undersigned participant
(“Participant”) for participation in a mushroom foraging tour conducted by the Guide in
Mount Shasta, California, and surrounding areas.

1. ASSUMPTION OF RISKS
Participant acknowledges and agrees that mushroom foraging and outdoor activities
involve inherent risks, including but not limited to:
Uneven or rough terrain, slips, trips, and falls
Exposure to wildlife, insects, and poisonous plants
Inclement weather and changing environmental conditions
The risk of encountering or handling toxic or poisonous mushrooms
Participant understands that identification of wild mushrooms is complex and that, while
the Guide provides educational information, there is no guarantee of safety or edibility of
any mushroom.
Participant voluntarily assumes full responsibility for all risks associated with participation
in the tour, including any injury, illness, death, or property damage that may occur during or
after the activity.

2. RELEASE OF LIABILITY AND WAIVER OF CLAIMS
Participant, on behalf of themselves and their heirs, assigns, personal representatives, and
next of kin, hereby releases, waives, and discharges the Guide, their agents, employees,
contractors, volunteers, and any landowners or land managers from any and all claims,
liabilities, damages, demands, actions, or causes of action arising out of or related to:
Injury, illness, or death resulting from participation in the tour
Accidents, falls, wildlife encounters, allergic reactions, or exposure to hazardous plants or
fungi

Handling or consuming any wild mushrooms or other foraged materials
Becoming lost, separated from the group, or encountering unforeseen natural hazards
This release applies whether caused by negligence or otherwise, to the fullest extent
permitted by law.

3. AGREEMENT NOT TO SUE
Participant agrees that they will not bring any lawsuit, claim, or legal action against the
Guide or any affiliated persons for any injury, illness, loss, or damage arising from
participation in the tour.

4. HOLD HARMLESS AND INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless the Guide, their agents,
employees, contractors, volunteers, and any landowners or land managers from and
against any and all claims, demands, damages, losses, costs, or expenses (including
reasonable attorney’s fees) arising out of or related to Participant’s participation in the tour,
including but not limited to claims arising from:
Participant’s own actions or omissions
Failure to follow instructions or safety guidelines
Any injury or damage caused by Participant to themselves or others

5. MEDICAL AUTHORIZATION AND FINANCIAL RESPONSIBILITY
In the event of an emergency, Participant authorizes the Guide to obtain medical
assistance on their behalf. Participant agrees to be financially responsible for any medical
treatment or related costs incurred.

6. PARTICIPANT RESPONSIBILITY
Participant acknowledges and agrees that they are responsible for:
Wearing appropriate clothing and footwear for outdoor conditions
Remaining with the group and following all instructions provided by the Guide
Refraining from consuming any foraged mushrooms unless explicitly advised by a qualified
expert
Accepting full responsibility for any misidentification or mistaken consumption

Not holding the Guide liable for errors in judgment, identification, or personal decision-
making.

7. ACKNOWLEDGMENT AND SIGNATURE
Participant acknowledges that they have read and fully understand this Agreement,
understand that they are giving up substantial legal rights, and are signing this Agreement
freely and voluntarily.
